Obtaining Your Deposit Back from Your Landlord

Whether you are ready to move or your lease has simply ended, obtaining your deposit back from your landlord can be a straightforward process. Follow these steps to ensure your deposit is promptly and efficiently returned.

Step 1: Inform Your Landlord in Writing

As soon as you know you're ready to vacate the property, inform your landlord in writing of your intent to move out. Also, include your forwarding address so they can return your security deposit.

Step 2: Write a Checklist

Before you vacate the premises, walk through the rental with your landlord and make a list of any damage. This will allow you to dispute any deductions from your security deposit that are unrelated to normal wear and tear.

Step 3: Clean and Repair

Once you create a checklist, start the repairs and cleaning processes needed in order to meet the standards for a deposit return. Remember to save all documentation and receipts from the cleaners or repairs.

Step 4: Follow-up

After the premises have been repaired and cleaned, follow up with your landlord to remind them to refund your deposit. According to most state laws, your landlord has up to 30 days to return your security deposit. You should also keep an eye on the mailbox for your refund.

Step 5: Take Legal Action

If you haven't received your deposit back within the allotted time period, contact your state's department of consumer affairs for legal advice. You can also take your landlord to small claims court in order to seek restitution for the full amount of your deposit.
